Establishing Paternity Through a Paternity Test

If there is a dispute as to the paternity of a child, a person can establish paternity through paternity tests, such as DNA tests and blood tests. Samples are taken from the mother, the presumed father, and the child. Results of the test can take approximately four to six weeks.

Paternity, Child Support, and Child Custody

Both the mother and father of the child have legal rights after paternity is established. Each party has the right to seek a court order for child support or for child custody or visitation rights. Additionally, the father most likely will be entitled to shared parental responsibility for the minor child and have an equal entitlement to be involved in the child's life and be a part of the decisions made about the child's upbringing.

It is important to recognize that the establishment of paternity and support through the Department of Revenue, or another state agency does NOT address issues of visitation and custody. Unfortunately, the public has not been educated as to what process needs to be performed in order to enforce and establish a parent's rights.
